LotPencil Terms of Service

LotPencil is a product of Kavanagh LLC ("we", "us"). By using lotpencil.com, the LotPencil web app, or the LotPencil Chrome extension (together, "LotPencil"), you agree to these terms. They are written to be read, not skimmed — they are short.

The one thing to know: LotPencil produces cost and value estimates from a model. It is not an appraisal, a bid, a loan commitment, or financial, legal, or investment advice. Verify every number with your own contractors, lender, and professionals before you act on it.

1. What LotPencil is

LotPencil is underwriting software for ground-up residential development in Los Angeles County. It models construction costs, fees, financing, and resale values for a property from public records, its own calibrated cost tables, and the inputs you provide. Real projects diverge from any model: soil, permitting, market timing, contractor pricing, and a hundred other things move the numbers. You are responsible for your own investment decisions.

2. Free tier and Pro

The free tier includes three property analyses per calendar month. We may change the free allowance with notice on the site.
Pro is offered as a monthly subscription or as a one-time "founder lifetime" purchase. Pro removes the monthly limit, unlocks white-label PDF export, and syncs your saved pipeline across your devices.
A Pro license key is for one person or one firm's internal use on up to five devices. Don't share, resell, or publish keys. We may revoke keys that are shared publicly.
"Lifetime" means for as long as LotPencil is offered. If we ever discontinue the product we will give lifetime holders at least 90 days' notice.

3. Payments and the 30-day refund policy

Payments are processed by Stripe. Your receipt and card statement show Kavanagh LLC, LotPencil's parent company.
30-day no-questions refund. Any first purchase — the first month of a subscription or the founder lifetime license — can be refunded in full within 30 days of payment. Email sales@lotpencil.com from your purchase email, or use "Request a refund" in the app's Settings. Refunds are issued to the original payment method, usually within one business day; Pro access ends when the refund is issued and any synced pipeline is deleted from our server.
Subscriptions renew monthly until cancelled. Cancel any time by emailing sales@lotpencil.com; access continues to the end of the paid period. Renewal charges after the first 30 days are not refundable, but we will always stop future billing on request.
Prices are in US dollars and may change; changes never affect a lifetime license already purchased, and subscription changes take effect at the next renewal with notice.

4. Your data

LotPencil is local-first: analyses run in your browser and your deal data stays on your device unless you are a Pro user, in which case your saved pipeline and branding are stored on our license server so your other devices can load them. The full list of what leaves your browser is in the Privacy Policy. You own your inputs and outputs; we claim no rights to your deals, reports, or branding.

5. Acceptable use

Don't attempt to circumvent the free-tier limit or license checks, overload or scrape our services, reverse-engineer the cost model for resale, or use LotPencil for anything unlawful. The Chrome extension reads the listing page you are on only when you click its button.

6. No warranty; limitation of liability

LotPencil is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Kavanagh LLC is not liable for any indirect, incidental, consequential, or special damages, or for any lost profits, lost deals, or investment losses, arising from your use of LotPencil, even if advised of the possibility. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

7. Changes

We improve the model and the product continuously; numbers for the same property can change between versions as costs and comps are updated. We may update these terms; material changes will be posted here with a new effective date, and continued use after that date means you accept them.

8. Governing law

These terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
